Please read all these terms and conditions.
As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. These Terms and Conditions will apply to the purchase of the goods by you the customer, from DMV Artistic Tailoring registered at 85 Great Portland Street, First Floor, W1W 7LT with email address Info@dmvart.com; telephone number 0203 137 1688 ; fax number 020 7183 3073.These are the Terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.
The description of the Goods is as set out in our website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in colour or other content, such as size or shape.
DMV Artistic Tailoring seller will make the goods in accordance with body measurements, design and specification requested and signed for by the customer.
When an Order for a Goods has been made, we can reject it for any reason, although we will try to tell you the reason without delay. No variation of the Order, whether about description of the Goods, price or otherwise, can be made after it has been placed, unless the variation is agreed by the Customer and the seller. Changes to the Order can be requested within 1 day after order has been placed.
If customer does not clearly specify each detail of the goods during first appointment or within 1 following day after placing an order, these will be made in a style of The Seller’s choosing.
Seller may charge or refuse making any amendments after garments have been completed to an order specification.
At DMV Artistic Tailoring we will make every effort to book your appointment at convenient time and location. All appointments are subject to availability. In case of cancellation of previously booked location, seller will provide an alternative venue. DMV Artistic Tailoring will not be responsible for journey expenses of a client travelling to and from the fitting appointments.
Fabric and reorders
At the initial appointment client will select garment cloth from a small swatch of fabric. If the same garment is being reordered after some period of time, cloth could vary slightly in colour due to being cut from a different roll.
In case of cloth being discontinued DMV Artistic Tailoring reserves the right to offer an alternative cloth of nearest similar quality.
Price and Payment
Prices and charges include VAT at the rate applicable at the time of the Order.
We require 50% of the Payment for the Goods as a deposit payment at the initial consultation appointment and a full balance must be paid at collection day or prior to a delivery. You can pay in cash or by submitting your credit or debit card details with your order. We can take full payment immediately or otherwise before delivery of the Goods.
We use Squareup Europe Ltd. to process your payment and we accept all major debit and credit cards.
Delivery times, Fittings, Collection
The Goods from our Made to Measure range will be ready for first fitting appointment within 6 to 8 weeks with standard service and 4 weeks with express service. Should there be any adjustments to a fit needed, completion of those will be made within 1 week after initial fitting and date of the next fitting/collection will be agreed between seller and the customer.
The goods from our Bespoke range will be ready for a Basted fitting appointment within 6 weeks and fully finished for a second fitting/collection within 4-6 week.
Surcharge for the express service is applicable and fee is fully refundable if the Goods are not delivered by specified date.
We do not generally deliver to addresses outside England and Wales, Scotland, Northern Ireland, the Isle of Man and Channels Islands. If, however, we accept an Order for delivery outside that area, you may need to pay import duties or other taxes, as we will not pay them.
If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.
The Goods will become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the Goods before accepting them. Risk of damage to, or loss of, the Goods will pass to you when the Goods are delivered to you.
You do not own the Goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the Goods still owned by you, in which case you must return them or allow us to collect them.
Uncollected garments will be stored with seller for up to 6 month after the completion date. After this DMV Artistic Tailoring reserves the right to dispose of the garments.
DMV Artistic Tailoring reserves the right to conduct as many fittings as is necessary to ensure a perfect fit of the goods or to re make the goods again at any time if necessary.
Customer is obliged to inform the seller of any body measurements changes which are planned or occur between fitting appointments and seller reserves the right to charge for any alteration resulting from a change in body shape.
We will provide after-sales service: Alterations and mending will be available free of charge within 3 months after collection and final settlement. Alterations on garments due to a significant weight loss or weight gain may be a subject to additional charge.
Withdrawal and cancellation
You can withdraw the Order by telling us before the Order is placed, if you simply wish to change your mind and without giving us a reason, and without incurring any liability.
You can cancel the Order for any Goods which are made to your special requirements by telling us no later than 1 day after the Order was placed, and before we process the order. Then we will without delay refund to you the price for those Goods, but we can retain any separate delivery charge. This does not affect your rights when the reason for the cancellation is any defective Goods.
In any case, regardless of events beyond our control, if we do not deliver the Goods on time, you can (in addition to any other remedies) treat the Contract at an end if:
we have refused to deliver the Goods, or if delivery on time is essential taking into account all the relevant circumstances at the time the Order was made, or if you told us before the Order was made that delivery on time was essential; or after we have failed to deliver on time, you have specified a later period which is appropriate to the circumstances and we have not delivered within that period.
If you treat the Order at an end, we will (in addition to other remedies) promptly return all payments made under the Contract.
Circumstances beyond the control of either party
In the event of any failure by a party because of something beyond its reasonable control, the party will advise the other party as soon as reasonably practicable; and the party’s obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer’s above rights relating to delivery and the right to cancel.
Governing law, jurisdiction and complaints
The Contract (including any non-contractual matters) is governed by the law of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland. We try to avoid any dispute, so we deal with complaints as follows: If a dispute occurs customers should contact us directly. We will aim to respond with an appropriate solution within 5 days.
